Terms of Service

1. Agreement to Terms
By accessing or using Dzoby ("Platform", "Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Platform.
These Terms constitute a legally binding agreement between you and Dzoby. We reserve the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the modified Terms.
2. Eligibility
You must meet the following requirements to use our Platform:
- Be at least 16 years of age (or the age of majority in your jurisdiction)
- Have the legal capacity to enter into binding contracts
- Not be barred from using the Service under applicable laws
- Provide accurate and complete registration information
- Maintain the security and confidentiality of your account credentials
3. User Accounts
3.1 Account Types
Our Platform offers two primary account types:
- Artists/Musicians: Create profiles, apply for gigs, and receive bookings
- Event Organizers: Post gigs, search for talent, and manage bookings
3.2 Account Responsibilities
- You are responsible for all activity on your account
- Keep your password secure and do not share it with others
- Notify us immediately of any unauthorized access
- Provide accurate, current, and complete information
- You may not create multiple accounts or transfer your account without permission
3.3 Account Termination
We reserve the right to suspend or terminate your account at our discretion, including for violations of these Terms, fraudulent activity, or behavior that harms other users or the Platform.
4. Platform Services
4.1 Gig Posting and Applications
Organizers may:
- Create and publish gig opportunities
- Set requirements, budgets, and event details
- Review applications from artists
- Accept or reject applications
Artists may:
- Browse and search for gig opportunities
- Submit applications with proposals
- Negotiate terms with organizers
- Accept or decline bookings
4.2 Booking Agreements
When an organizer accepts an artist's application, a binding agreement is formed between the parties. Dzoby acts as a facilitator but is not a party to the agreement. Both parties must fulfill their obligations:
- Artists: Perform at the agreed time and meet stated requirements
- Organizers: Pay agreed fees and provide stated conditions
5. Payments and Fees
5.1 Payment Processing
- All payments are processed securely through Stripe
- Organizers pay the agreed booking fee upfront
- Funds are held in escrow until the event is completed
- Artists must connect a Stripe account to receive payouts
5.2 Platform Fees
Dzoby charges a service fee on successful bookings with a progressive tier structure:
- Minimum fee: 10 PLN per booking
- 8% on the first 1,000 PLN
- 6% on amounts between 1,000-5,000 PLN
- 4% on amounts between 5,000-20,000 PLN
- 3% on amounts above 20,000 PLN
Platform fees are deducted from the artist's payout. The organizer pays the full agreed amount.
5.3 Payment Release and Disputes
- Payments are held in escrow for 24 hours (private/corporate events) or 48 hours (public/festival events) after the event
- Organizers may file a complaint during this window if issues arise
- If no complaint is filed, funds are automatically released to the artist
- Disputed payments are reviewed by Dzoby administrators
- Resolution may result in full payment to artist, partial refund, or full refund to organizer
5.4 Refunds and Cancellations
- Cancellation policies are subject to mutual agreement between parties
- Either party may terminate a booking through the Platform
- Refunds for cancellations are determined by timing and circumstances
- Dzoby may mediate disputes but is not liable for cancellation terms
6. User Content and Conduct
6.1 Content Ownership
You retain ownership of content you post (profiles, messages, media, etc.). By posting content, you grant Dzoby a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content for operating the Platform.
6.2 Prohibited Conduct
You agree not to:
- Post false, misleading, or fraudulent information
- Impersonate others or misrepresent your identity
- Harass, abuse, or threaten other users
- Post content that is illegal, obscene, defamatory, or infringes on rights of others
- Attempt to circumvent payment systems or fees
- Use automated systems (bots, scrapers) without permission
- Interfere with Platform operations or security
- Solicit bookings outside the Platform to avoid fees (after initial contact via Dzoby)
6.3 Content Moderation
We reserve the right to review, remove, or modify content that violates these Terms or is otherwise objectionable. We are not obligated to monitor all content but may do so at our discretion.
7. Intellectual Property
- The Platform, including design, code, logos, and trademarks, is owned by Dzoby
- You may not copy, modify, distribute, or reverse-engineer any part of the Platform
- Dzoby name and logo are trademarks and may not be used without permission

8. Disclaimers and Limitation of Liability
8.1 Platform Provided "As Is"
The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not guarantee that the Platform will be uninterrupted, secure, or error-free.
8.2 User Interactions
Dzoby is not a party to agreements between artists and organizers. We do not guarantee the quality, safety, or legality of user interactions, performances, or events. Users are solely responsible for their agreements and conduct.
8.3 Limitation of Liability
To the fullest extent permitted by law, Dzoby and its affiliates, officers, directors, and employees shall not be liable for:
- Indirect, incidental, special, or consequential damages
- Loss of profits, data, or business opportunities
- User conduct or content
- Errors, interruptions, or security breaches
Our total liability shall not exceed the fees paid by you to Dzoby in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless Dzoby from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or infringement of third-party rights.
10. Dispute Resolution
10.1 Governing Law
These Terms are governed by the laws of Poland. Any disputes shall be resolved in the courts of Poland.
10.2 User Disputes
Disputes between users should first be resolved directly. If resolution is not possible, Dzoby may offer mediation services but is not obligated to do so. For payment disputes, see Section 5.3.
11. Privacy
Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.
12. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or Platform notification. Continued use after changes constitutes acceptance. If you do not agree, discontinue use of the Platform.
